1. Scope and subject matter of the contract

These general terms and conditions (hereinafter: "T&C") regulate the use of the mobile application ("App" or "TheRightGuy" or "Plattform") between us (hereinafter: "TheRightGuy" or "we") and you (hereinafter "I am looking for a job” as ”Employee” and I am looking for a service as “Contractor”) as orders concluded with our customers. If you do not accept the terms and conditions, you may not use the services of TheRightGuy.
The version of the Terms and Conditions valid between us and the client at the time the respective order is concluded is decisive.
We do not accept deviating conditions of an employee or contractor (hereinafter "the Plattform user"). This also applies if the customer refers to these conditions in declarations and we do not expressly object to their inclusion.

2. Terminology

"Contractor" is the person who creates acontract or is looking for an offer.
"Employee" is the one who creates an offer or is looking for a contract.
"Offer" is created by an "Employee" by wanting to sell his / her service line for a certain hourly rate.
"Contract" is created by the contractor by looking for a specific service.

3. Our services and how to use them

Nando Conception offers via ´TheRightGuy´ (hereinafter "App" or "Plattform") the online arrangement of services for daily needs between employee and contractor. In order to be able to use the services at TheRightGuy, an user account must be created.
The platform user must first create a user account. However, the app also offers the platform user an overview without creating a user account.
To do this, the platform user must register with their name, telephone number and email address. The platform user is responsible for ensuring that the data he / she provides is always up-to-date and truthful. The platform user will ensure that unauthorized persons do not have access to the terminal device used and / or the data required via the platform user's user account. If the platform user violates this obligation, the platform user is liable for all activities emanating from his user account that are caused by this breach of duty, unless the platform user is not responsible for them. The platform user is prohibited from using the user account of another person or attempting to do so and / or accessing the personal payment data of another person or using the personal payment data of another person, creating a user
account using a falsified identity or to create the identity of another person or to access the platform in a different way than via the access options provided by TheRightGuy. The platform user will inform us immediately after becoming aware of any unauthorized use of his user account. We strive to ensure that the app can be accessed continuously, but we accept no liability for its permanent availability.
We as a platform, we are not liable for the services not provided or for false identities or events that take place during the services.
We as a platform, we are not liable for any accidents at the place of work or damage that occurs during services.
We as a platform, we are not liable for the quality of the services or the personalities of the platform user.
The evaluation of an employee or contractor can be made mutually.

4. Prices and terms of payment

The app is based on the agreement between the two parties via the platform and, in the end, a notification fee is paid by the contractor. The app is free for the employees and there are two payment methods for the contractor:

a) The contractor pays a one-time view fee of ´ € 1´ to open the profile of an employee or to be displayed.
b) The contract looks for a suitable subscription that he/she can open as many profiles as he/she likes during this period.

By sending an offer for a contract that has been created by a contractor, the employee accepts the payment of the hourly rate according to the job description of the contractor.
By submitting of a contract the contractor guarantees to pay the hourly rate according to the job description of the contrac to the employee.
In the event of a contractor's cancellation or a disagreement about the type of service, time, location, etc., the view fee will no longer be reimbursed.
Unless otherwise agreed, Stripe Payments UK, Ltd, The Bower Warehouse, 7th floor, 211 Old street, London EC1V 9NR, England will provide you with payment processing services ("Payment Services") in connection therewith ("Stripe").
TheRightGuy reserves the right to change these terms and conditions at any time in accordance with this provision. If TheRightGuy makes changes to these terms and conditions, TheRightGuy will notify the platform users of the TheRightGuy platform by email at least 30 days before the "Amended Terms and Conditions" come into effect ("notification").

5. Termination and temporary blocking of the user account

If the platform user uses the app for other purposes or tries to create a FAKE account, the account may be temporarily or completely blocked by the admin.

6. Data protection

TheRightGuy processes the data collected via the platform in accordance with the relevant legal provisions, in particular the General Data Protection Regulation, the Federal Data Protection Act and the Telemedia Act.
